Participants’ personal data will only be used for the following purposes: ensuring the proper management of the Competition in accordance with these Rules and complying with legal and regulatory obligations.

Participants also agree to the transmission of their personal data to the participating brand, Lucibelle, and agree to subscribe to Lucibelle’s newsletter.

8.2. Each Participant has the right to access, rectify, restrict, port and object to the processing of their personal data, as well as the right to erasure and to withdraw their consent at any time, and to define post-mortem directives.

These rights may be exercised by email at e-boutique@patyka.com or by post at the following address:

Article 9: Competition Rules

“The Organiser” reserves the right to extend, shorten, modify or cancel the Competition at any time, particularly in the event of force majeure, without participants being entitled to claim any compensation.

Article 10: Industrial and Intellectual Property

The reproduction, representation or exploitation of all or part of the elements comprising the contest, including these rules, is strictly prohibited. All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the website, as well as on websites accessible through hyperlinks provided on the website, are the exclusive property of their respective owners and are protected worldwide under the provisions of the French Intellectual Property Code. Any unauthorised reproduction constitutes an infringement subject to criminal penalties. Any unauthorised reproduction, in whole or in part, of these trademarks, logos and distinctive signs constitutes an infringement subject to criminal penalties. Participation in this contest implies the participant’s full and unconditional acceptance of these rules.

Article 11: Liability

The Organizer shall not be held liable in the event of force majeure or an unforeseeable event beyond its control. The Organizer shall not be held liable for delays, loss, theft or damage to mail, or for illegible postmarks caused by postal services. The Organizer shall likewise not be held liable, and no claim may be brought against it, in the event of circumstances constituting force majeure (strikes, adverse weather conditions, etc.) that partially or completely prevent participants from taking part in the contest and/or winners from benefiting from their prizes.

The Organizer, its service providers and partners shall under no circumstances be held liable for any incidents that may occur in connection with the use of the prizes by the beneficiaries or their guests once the winners have taken possession of them. Likewise, the Organizer, its service providers and partners shall not be held liable for the loss or theft of prizes by the beneficiaries once the winners have taken possession of them. Any additional costs necessary to take possession of the prizes shall be borne entirely by the winners, who shall not be entitled to claim any compensation from the Organizer or its service providers or partners.

This contest is neither administered nor sponsored by Facebook, which the Organizer releases from any liability.

Article 12: Disputes & Claims

These rules are governed by French law. The Organizer reserves the right to make a final decision on any difficulty that may arise concerning the interpretation or application of these rules, it being understood that no dispute may be raised, in particular concerning the contest procedures, results, prizes or receipt thereof, more than one month after the end of the contest. Except in the event of obvious errors, it is agreed that the information resulting from the Organizer’s contest systems shall have evidential value in any dispute concerning connection details and the electronic processing of information relating to the contest.

Any claim must be submitted to the Organizer within one month of the end date of the contest. After this deadline, no claim will be accepted. Participation in the contest constitutes full acceptance of these rules.

Article 13: Agreement on Evidence

By express agreement between the participant and the Organizer, the Organizer’s computer systems and files shall constitute the sole evidence. Computerised records stored in the Organizer’s IT systems under reasonable conditions of security and reliability shall be considered evidence of the relationships and communications between the Organizer and the participant.

Accordingly, unless there is an obvious error, the Organizer may rely, in particular for evidentiary purposes, on any acts, facts or omissions recorded in programs, data, files, records, transactions and other elements (such as tracking reports or other statements) in digital or electronic form or format, established, received or stored directly or indirectly by the Organizer, particularly within its IT systems.

These elements shall therefore constitute evidence and, if submitted as evidence by the Organizer in any contentious or other proceedings, shall be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same evidential value as any document established, received or stored in writing.

Transactions of any kind carried out using the username and password assigned to a participant following registration shall be irrebuttably presumed to have been carried out under the participant’s responsibility.
